Advertising Terms and Conditions

  1. Definitions
    "Advertiser" refers to the individual or company purchasing advertising space. "Station" refers to the radio station the advertising has been booked on (e.g. Horizon Radio Milton Keynes).

  2. Advertising Content

    • The Advertiser is responsible for ensuring that all advertising material provided complies with legal requirements and broadcasting standards.
    • The Station reserves the right to reject or request changes to any advertising content that is unlawful, offensive, or otherwise unsuitable for broadcast.
    • Once the script or advertisement is approved and signed off by the Advertiser, any further changes will incur additional charges based on production time and resources required.
  3. Payment Terms

    • All advertisements must be paid for in full before broadcast.
    • Payment is due within 14 days of your monthly invoice unless otherwise agreed in writing.
    • Failure to pay prior to broadcast may result in a delay or cancellation of the advertisement. The Station is not responsible for any missed airings due to late payment.
    • Advertisements will not be broadcast until payment is received in full for the current month.
  4. Scheduling and Airing

    • The Station will make reasonable efforts to air advertisements at the agreed times, but no specific time slots are guaranteed unless specifically agreed in writing.
    • In the event of a scheduling conflict or technical issue, the Station will attempt to reschedule the advertisement at the nearest available time. No refunds will be issued in such cases unless the rescheduling substantially affects the purpose of the advertisement.
  5. Cancellation Policy

    • The Advertiser may cancel the contract with a minimum of 7 days’ notice prior to the first scheduled broadcast.
    • Cancellations made with less than 7 days’ notice will incur a fee of 50% of the total contract value.
    • No refunds will be issued for cancellations after the advertisement has aired.
  6. Changes and Amendments

    • Any amendments to the advertisement content after approval will be subject to additional charges. These charges will depend on the nature and scope of the required changes.
    • Changes to the terms of the contract must be agreed upon in writing by both parties.
  7. Liability

    • The Station will not be liable for any loss, damage, or expense incurred by the Advertiser due to the content or timing of the broadcast, except in cases of gross negligence by the Station.
    • In the event of an error in broadcasting, the Station’s liability is limited to a re-broadcast of the advertisement at an agreed time or a refund equivalent to the cost of the missed broadcast.
  8. Indemnity

    • The Advertiser agrees to indemnify the Station against any claims, damages, or legal costs arising from the content of the advertisement, including infringement of intellectual property rights, defamation, or breach of regulations.
  9. Confidentiality

    • Both parties agree to keep the terms of the contract and any related negotiations confidential, except where disclosure is required by law.
  10. Governing Law

  • This agreement is governed by the laws of England, and both parties submit to the jurisdiction of the courts in the United Kingdom.
  1. Force Majeure
  • The Station will not be held responsible for failure to perform its obligations under this contract if such failure is due to circumstances beyond its reasonable control, including but not limited to natural disasters, technical failures, or legal restrictions.
